“XPPS” as stated in this document relates specifically to “The Fast-100 Xtreme Postcard Profits System” Program (“XPPS”) and “Xtreme Business Profits”.

CAREFULLY READ THE FOLLOWING REPRESENTATIVE AGREEMENT. YOU ACCEPT AND AGREE TO BE BOUND BY THIS AGREEMENT. IT IS AN INTEGRAL PART OF THE REPRESENTATIVE AGREEMENT WHICH MUST BE AGREED TO UPON PURCHASE. BY PURCHASING ACCESS TO THE MAIN XPPS PRODUCT AND THE RESALE RIGHTS TO THE MAIN XPPS PRODUCT, AND MAKING PAYMENT TO YOUR SPONSOR (AND TO THEIR SPONSOR) FOR THE AFOREMENTIONED PRODUCTS, YOU ARE INDICATING THAT YOU HAVE READ THIS AGREEMENT AND ACCEPT ITS TERMS. IF YOU DO NOT AGREE TO THIS, DO NOT PROCEED!

GENERAL TERMS

I have read the TERMS OF USE and EARNINGS DISCLAIMER relating to The Fast-100 Xtreme Postcard Profits System (otherwise referred to as “XPPS” in this agreement) and agree to abide by them. By sending payment to purchase access to the XPPS online product, I am agreeing to the terms of this Agreement.

I am at least 18 years of age. I agree that I am an independent contractor, responsible for determining my own business activities and that I am not an agent or employee of the XPPS.

I am responsible for the payment of all federal and state self-employment taxes and any other tax required under any federal, state or regulatory taxing agency.

I acknowledge that there is no income guarantee, and that any examples of hypothetical income levels are strictly examples and I realize I may earn more or less than these examples.

I agree that I will not make any specific income claims or ”guaranteed income” claims within any offline or online marketing I undertake when promoting the XPPS.

No one has made any income claims to me as to what I should expect to earn over the short term. I recognize that some XPPS members will create a positive cash flow much quicker than others. Some of this is due to sheer luck and some due to actions that some system owners may take to build their income faster than the norm.

I understand that it is my responsibility to adhere to any/all state guidelines pertaining to offline and online business opportunities. I understand that I am solely responsible for my actions.

If I choose to do additional advertising to drive prospects to my XPPS website, I agree to promote XPPS as an offline postcard marketing system designed to enable any business or product owner to increase their profits through usage of the aforementioned system first, and that the income generated from marketing the XPPS offline postcard marketing system itself is optional but recommended.

I understand when a prospect registers to join the XPPS program, the owner of the website where the prospect registers will be deemed the sponsor of that new member.

While incentives are a regular part of marketing and promotion, I will not promote special incentives such as “price discounts” or “special offers” or “free passes” or “free entry” relative to either the main product purchase or the product resale rights purchase in order to entice a prospect to join the XPPS under me rather than through another XPPS member.

I agree to hold harmless “The Fast-100 Xtreme Postcard Profits System” and & “Xtreme Business Profits”, as well as any of its representatives, employees, and affiliates for any claims, damages or liabilities that may arise out of my business activities or practices associated with my XPPS membership.

I understand that it is my obligation and responsibility to purchase both the access to the XPPS main product (@US$100 or equivalent) and resale right to the XPPS main product (@US$100 or equivalent) directly from my sponsor (and my sponsor’s sponsor respectively) as specified within my XPPS back office website.

I further understand is it the responsibility of XPPS to provide both access to the XPPS main product and grant resale rights to the XPPS main product after the funds have been marked as “received” in both the sponsor and sponsor’s sponsor back office.

I understand that at the time of purchase, my respective purchases of the XPPS main product and the resale rights to the XPPS main product are strictly non-refundable. This subsequently extends to the buyer (i.e. the new XPPS member). I also understand that in instances where a refund is requested within 7 (seven) days from the original purchase date, and to uphold the good name of the XPPS, that I will honor the refund request via the same method/s in which the products were initially purchased.

In promoting my XPPS business, I agree to strictly adhere to all applicable laws, including but not limited to The Can Spam Act of 2003. I will never send unsolicited email (spam) to promote XPPS. I agree to hold harmless XPPS, its owners, employees, and other affiliates, from the consequences of my actions.

I understand that no Attorney General or other regulatory authority ever registers or reviews, endorses or approves any product, compensation program or company, and I will make no such claim to others. I acknowledge the XPPS has the unilateral right to change the terms of this agreement at any time and understand that it is my affirmative duty to keep myself informed of changes and recognize that I am bound by any revisions made to either this XPPS Representative Agreement and other included within the XPPS websites and XPPS back office.

WEBSITES - GENERAL GUIDELINES:

All content is the property of XPPS and unauthorized content/promulgations are strictly phrohibited. Unique Registry Addresses outside of the authorized sub-URL/domain must only redirect back to the licensed sub-domain/URL.

Assembling your own XPPS-specific opt-in website is permitted, pending prior approval of the site by XPPS prior to launch. Assembling your own series of autoresponder messages (linked to your own XPPS-specific opt-in website) is permitted, pending prior approval of the site by XPPS prior to launch.

Assembling your own marketing & promotional printed materials (including but not limited to postcards, flyers, leaflets etc), is permitted, pending prior approval of the materials by XPPS prior to use & distribution.

Assembling your own ”complete website system”, whether provided free to your Team or at a cost, (including but not limited to opt-in websites, main website & back office websites) is not permitted under any circumstances.

Formulating your own ”Co-op Advertising Program” (for your group) is permitted, pending prior approval by XPPS prior to launch. Information relating to the ”Co-op Advertising Program” must prominently display the disclaimer: “This is NOT an official Fast-100 Xtreme Postcard Profits System Co-op Advertising Program. This is a private Co-op organized by (Name or group) who is/are solely responsible for its marketing recommendations.”

Assembling your own ”Team support” website is permitted, pending prior approval of the site by XPPS prior to launch.

In instances where XPPS approve a members self-assembled XPPS-specific opt-in website or a self-assembled ”Team support” website, these materials must prominently display the disclaimer: “This is NOT an official Fast-100 Xtreme Postcard Profits System website. This is a private website of (Name or group) which is solely responsible for its content and marketing recommendations.”

UNDERSTACKING:

As an XPPS member, you are not allowed, under any circumstances, to be re-sponsored into the XPPS program again in order to circumvent the system and cut your sponsor off from any possible future residual payments. We will contact the specific members in question if any instances of this activity are brought to our attention.

SPONSOR DUTIES:

Within reason, it is your responsibility as an XPPS sponsor to offer ongoing help, advice and assistance to all your personal referrals. Not only is this beneficial from a financial perspective, but it also sets a good example to your team and it also general good business practice when building your team and helping your team members to succeed. The XPPS is not a ”bring them in and leave them to it” program.

However, if we receive repeated complaints from members not receiving an acceptable level of support or assistance from their original sponsor, then we shall, at our discretion, and on a case-by-case basis, seek to re-assign that member to an alternate sponsor. We will also endeavor to contact the sponsor in question in order to seek a resolve to the issue and prior to taking any action.

TRANSFER OF OWNERSHIP

You may transfer all your rights to use the XPPS system, websites, software and documentation to another person or legal entity provided you also transfer this Agreement. Should the transfer take place, the initial arrangement with your current sponsor will remain intact. Usage of the database of prospects & members (generated by the current business owner) will be agreed upon between the current business owner and new owner prior to reaching a final agreement & transfer. Such transfer is also subject to prior written approval by the XPPS, otherwise the transfer is void.
